Terms and Conditions
1. Activity
SM Holiday Property manages rentals on behalf of the property owner or administrator. SM Holiday Property is not a tour operator or travel agency; it acts solely as an intermediary. Any additional services not specified in the contract will not be the responsibility of SM Holiday Property.
2. Reservations and Payments
SM Holiday Property will confirm your reservation via email, at which point it becomes binding. The reservation is made on behalf of the property owner or administrator and is only valid for the specified period and number of registered guests.
After receiving the confirmation, a deposit of 30% of the total price must be transferred to SM Holiday Property within 5 business days. Failure to make the payment within this period will result in automatic cancellation of the reservation without the right to any claims.
The remaining balance must be paid upon arrival, in cash to the owner or their representative at the property, unless otherwise agreed.
3. Security Deposit
If a security deposit is required, it must be paid in cash upon arrival as a guarantee of compliance with the rental conditions.
4. Liability
The property information, including dimensions, distances, and features, is based on data provided by the owners, who are responsible for its accuracy. SM Holiday Property makes every effort to verify this information but is not liable for local changes made by third parties or circumstances beyond its knowledge.
SM Holiday Property is not responsible for damages or service interruptions due to force majeure, such as strikes, wars, earthquakes, construction noise, water supply cuts, or adverse weather conditions.
If the rental property becomes unusable due to unforeseen circumstances and cannot be immediately repaired, SM Holiday Property’s liability will be limited to the reimbursement of payments made.
The use of the property, including its facilities and equipment, is the tenant’s sole responsibility. Neither the owner nor SM Holiday Property will be liable for accidents, personal belongings, or theft within the property.
5. Damages and Liability
The tenant is personally responsible for any damages caused to the property or its facilities, whether by themselves or their guests. Any damages must be reported immediately to the owner or SM Holiday Property.
Upon arrival, the tenant must inspect the property and report any existing issues within 24 hours to the owner or SM Holiday Property.
6. Cancellations
If the tenant wishes to cancel a confirmed reservation, they must notify SM Holiday Property in writing via email. The following cancellation fees will apply:
- Up to 90 days before arrival: 30% penalty.
- Between 89 and 30 days before arrival: 50% penalty.
- 29 days or less before arrival: No refund.
A management fee of €50 will be charged for any changes or cancellations.
7. Right to Cancel the Reservation
The property owner or SM Holiday Property reserves the right to cancel a reservation under the following circumstances:
- Intentional damage: If the tenant or any accompanying guests deliberately cause damage to the property or its facilities. In this case, no refund will be given.
- Violation of house rules: If the tenant or any accompanying guests fail to follow the house rules, cause disturbances, or endanger others. No refund will be provided.
- Non-payment: If the tenant does not pay the remaining rental amount upon arrival or fails to leave the required security deposit.
8. Additional Services
Additional services offered by SM Holiday Property, such as car rental, are exclusively third-party services between the client and the service provider. SM Holiday Property is not responsible for these services or any related claims.
